Terms & Booking Conditions
Thank you for choosing to book with Whitley Elm Cottages. We look forward to welcoming you. By making this booking you are entering an agreement with us. Please read our terms and conditions of booking below.
1. Governing Law
The contract is made in England and is subject to English law. The Hirer agrees that the contract with the owner is made at the owner’s premises and that any proceedings between the parties shall be conducted in the County Court nearest to the Owner.
2. Prices Reservation and Deposit
The price of the cottage includes heating, electricity, hot water, bed linen, towels and tea towels. The reservation becomes a legally binding contract between us once a deposit of one third of the price is paid, and written confirmation is sent. The contract is non-cancellable & non-refundable.
3. Payment of Balance
The Balance of the price is payable no later than 6 weeks before the letting is to commence. No reminders will be sent. If the balance is not received in time, the Owners have a right to cancel the reservation, in which case the deposit will be forfeited.
4. Transferred Reservations
A transfer may only be carried out with the Owner’s consent. There will be an additional charge of £25 per booking for this change.
5. Cancellation
The Owner must be informed immediately of a cancellation by Recorded Delivery. In all cases the deposit will be forfeited. The Owners will try to re-let the accommodation but in the outcome that this is not possible the lead Hirer will remain liable to pay the full balance of the price due. Hirers are strongly recommended to arrange cancellation cover.
6. Additional Charges
The Hirer shall, on the termination of the letting, reimburse the Owners for the cost of any additional items or service that they have agreed with the owner.
7. Number of Occupants
At the time of reservation the Owners will specify the maximum number of occupants. Additional persons, including babies shall only be accommodated with express consent of the Owners and upon payment of the additional price specified. The Owners reserve the right to cancel if the conditions are not met.
8. Unsuitable Hirers
The Owners reserve the right to refuse to permit occupancy of the accommodation to any person who the Owners, in their opinion, consider to be unfit to take charge. The price therefore will be refunded in full. The Owners also reserve the right to re-possess the cottage if there is any damage or nuisance to other parties, or unreasonable behaviour. In this event no refund will be made.
9. Pets
Well-behaved Pets will only be accommodated by prior arrangement made at the time of booking at £35 per week each. Pets are not permitted to occupy beds or furniture or cause any damage to property. Dogs must be exercised on a lead at all times and must never be left unattended in the cottage.
Any fouling of lawns, path etc. must be cleared up without delay. The Hirer must bring the dogs bedding.
10. Care of the premises and indemnity
The Hirer must keep the holiday cottage and all furniture, fittings and effects in the same state of repair and cleanliness as at the time of initial occupancy, (reasonable wear and tear excepted). Any loss or damage will be charged and paid for by the Hirer in full at the time of departure. Breakage or damage should be reported immediately. The Hirer must not cause any nuisance or annoyance to occupants of nearby property. No naked flames or plug-in air fresheners.
11. Owner’s Rights of Entry
For the purpose of ensuring compliance with these conditions the Owners, with or without workmen, shall be entitled to enter into the premises at any time.
12. Owner’s Liability
The Owners do not accept responsibility for injury, loss or damage, including theft to any person or property of the Hirer or members of his party or pets or vehicles and their contents during the term of letting. If the Owner is for some reason beyond his control e.g. fire, flood, civil commotion, war, riot, sickness, etc. unable to make the cottage available and cannot provide a suitable alternative, all monies will be refunded, but no further liability accepted. Hirers must ensure that all personal possessions are removed on departure. Owners reserve the right to dispose of Hirers possessions after departure-without any further reference to Hirer.
13. Arrivals and Departures
The accommodation will be available from 4.00pm on the day of commencement of letting. The Hirer shall vacate the cottages be 10.00am on the day of departure, leaving it clean and tidy. A charge may be made if the Owner has any additional cleaning to carry out.
14. Basis of Occupancy
The accommodation is for short-term let only and no tenancy or other longer relationship is created.
15. Modifications and Descriptions
Every effort is made to keep the cottages as described in the current brochure/website. The Owner reserves the right to alter, substitute or withdraw any service, facilities or amenity at any time.
16. Complaints
In the event of a complaint about any aspect of the letting or the premises, the Hirer should, in the first instance, and in any event before departure, contact the Owners at the address and telephone number supplied, to allow remedial action to be taken. If unresolved the matter will be referred by the Owner to the English Association of Self-Catering Operators for arbitration by Dispute Settlement Services, Ltd. No complaint will be considered after departure.
17. Privacy Policy
Any data collected during the course of this booking will be stored on our computer(s). With your permission we may from time to time contact you about promotions and offers. We will not share your details with any third party.
